Since joining Swartz Campbell in 2013, Mr. Fitzmaurice had defended clients in premises liability matters, contract actions, and product liability suits throughout Pennsylvania. Mr. Fitzmaurice handles cases from inception to resolution, including drafting of preliminary objections and other pleadings; conducting discovery, including written discovery, depositions, and motion practice; drafting dispositive motions; and appellate practice. Mr. Fitzmaurice has obtained numerous judgments for clients in both state and federal court at the trial and appellate levels.
Representative matters include drafting a victorious motion for summary judgment in the Eastern District of Pennsylvania and subsequent successful appellate brief before the Third Circuit Court of Appeals based upon assumption of risk in a premises liability action; prevailing on a summary judgment motion in the Allegheny County Court of Common Pleas based upon successor liability; and preparing preliminary objections in the Philadelphia Court of Common Pleas based upon late joinder of client which led to a dismissal of all claims against client.
Mr. Fitzmaurice received his Juris Doctorate from Temple University, Beasley School of Law, with honors. He completed Temple’s nationally-ranked Integrated Trial Advocacy Program. He also received a Certificate in Trial Advocacy and was an editor of the Temple Political and Civil Rights Law Review. He earned his bachelor’s degree from the University of Pennsylvania, cum laude, majoring in Political Science with a concentration in American Politics.
