Argument in Superior Court

James C. Haggerty, Esquire recently presented argument to the Superior Court of Pennsylvania on behalf of an insurer in a case involving a coverage issue arising under the Pennsylvania Motor Vehicle Financial Responsibility Law, 75 Pa.C.S.A. § 1701 et seq. In Nationwide Mutual Insurance Company v. Catalini, the claimant had sought reformation of the underinsured motorist limits of his personal auto policy to the higher liability limits claiming that there had been no valid election of lower limits of underinsured motorist coverage. Following a non-jury trial in the Court of Common Pleas of Bucks County, a verdict and judgment was entered in favor of the insurer. The claimant appealed to the Superior Court. Oral argument was conducted before a three judge panel of the Superior Court. The oral argument was conducted in the Carbon County Courthouse in Jim Thorpe, Pennsylvania as part of the program of the Superior Court of Pennsylvania to conduct its business in various counties throughout the Commonwealth.
