ARGUMENT BEFORE SUPERIOR COURT

On December 7, 2010, James C. Haggerty, Esquire presented argument before the Superior Court of Pennsylvania in Harrisburg. In that case, Judge Lupas of the Court of Common Pleas of Luzerne County had entered summary judgment in favor of the defendant insurer in a case seeking recovery of underinsured motorist benefits. The plaintiff had claimed $600,000.00 in underinsured motorist benefits in connection with the serious injuries sustained in a motor vehicle accident. The defendant insurer maintained the position that the vehicle was not insured under the policy in question at the time of the accident. Following the entry of summary judgment in favor of the insurer by the Court of Common Pleas, the plaintiff appealed to the Superior Court. Oral argument was conducted before the Superior Court, at which time affirmation of the trial court decision in favor of the insurer was requested.
