BAD FAITH/FIRST PARTY

Swartz Campbell LLC has been actively involved for many years in the defense of bad faith matters brought directly against insurers in a wide variety of contexts ranging from breach of contract to defamation.  The attorneys defending insurers in bad faith litigation are also regularly involved in consulting general counsel, claims, and underwriting staff regarding claims handling practices, underwriting issues, and the prevention of claims against insurance carriers.

CLASS ACTIONS

Swartz Campbell LLC has developed a team dedicated to handling the demands of large scale and intricate class action litigation.  Senior attorneys with extensive experience defending class actions in multi-jurisdictional claims are charged with the leadership of this team.  The Class Action Unit is involved in the handling of class action matters (primarily on behalf of insurers) throughout the United States.  This Unit has served as both national and local counsel in matters involving some of the larger and most visible insurance class actions currently pending against insurers throughout the country.  The attorneys on the Class Action Unit are currently involved in handling class action certification matters on behalf of insurers throughout Pennsylvania and in Delaware, Florida, West Virginia, Tennessee, Alabama, Connecticut, New York, Michigan, Alaska and Ohio.

EMPLOYMENT AND LABOR

            Swartz Campbell attorneys counsel employers on personnel and employee benefits issues through its Employment and Labor Department.  These attorneys regularly defend employment discrimination lawsuits, employee benefit actions, wrongful discharge, whistleblower, breach of contract and sexual harassment claims. 

ENVIRONMENTAL

The Environmental Claims Unit has been actively involved in the defense of toxic torts and mass tort litigation since its inception in 1978.  Among the claims in which the firm has assumed a leading defense role are exposure to asbestos, chemical fumes, lead paint, latex and benzene.  Members of the Environmental Claims Unit have also been involved in Superfund litigation. 

INSURANCE COVERAGE

The Insurance Coverage Unit is comprised of attorneys who counsel and represent commercial and personal lines insurers in policy coverage disputes.  Swartz Campbell attorneys provide coverage opinions on defense and indemnity obligations in the third party liability and first party benefits realms.  They also regularly handle litigation involving coverage questions regarding first party benefits, bad faith, environmental issues, intellectual property, business risk, employment, property damage, construction and computer software.
